    家庭法披露简介

    在家庭法中,充分和坦诚的披露是指当事人有责任向对方提供相关文件及其副本。这是为确保所有可能影响案件结果的文件会被提出,以实现公平。即使是对自己不利的文件也是必需的,因为这会在解决争议问题或为案件开辟新的调查线索方面有所帮助。


    随着法律诉讼过程中情况的变化,任何新文件都应提供给你的律师,以便披露给对方。如果你是代表自己,你有责任向其他各方披露这些文件。以下信息仅适用于事项已在法庭进行时。


    关于信息披露的法律

    根据2001年《澳大利亚联邦巡回法院及家庭法院(家庭法)规则》所述,澳大利亚法律要求案件各方必须充分和坦诚地披露所有与案件相关的文件。

    未遵守披露标准及其后果

    如果任何一方未能提供完整和坦诚的披露,这可能会严重影响法庭的判决,并因此那方可能会面临重罚。


    首先,法院可能会将此类行为解释为故意试图影响法院公正审理案件,因此倾向于对被发现有此行为的当事人做出不利的判决。

    A brief introduction to disclosure in Family Law

    In Family Law, as a matter of full and frank disclosure, it is the duty of the parties involved to provide the other party with documents as well as copies of documents that would be relevant to the case. This ensures that all documentation that could affect a case’s outcomes is brought up to achieve fairness. Even documents that are opposed to one’s advantage are necessary and may prove useful in resolving an issue that is under dispute, or open new lines of inquiry for the case.


    As the situation changes throughout the course of legal proceedings, any new documents should be provided to your solicitor to disclose them to the other party. In the case of self-representation, it is incumbent for you to disclose these documents to the other parties yourself. The information below applies strictly when the matter has proceeded in Court.


    The Law on Disclosure

    Australian law, as outlined in The Federal Circuit and Family Court of Australia (Family Law) Rules 2001, requires that the parties to a case provide full and frank disclosure of all documents that are relevant to the case.


    Additionally, Australian Law requires that all parties involved in the matters file a written notice stating that they have read parts 6.1 and 6.2 of the Family Law Rules, and that they are aware of their duty to give full and frank disclosure of all relevant information, and that they have complied with it to the best of their ability.


    Court Procedure and the relevant documents that should be disclosed


    The type of documents that are required to be provided for disclosure varies with the specific context of each case. In any case, there are common documents that are usually provided to your solicitor to properly assess and evaluate the case. Under self-representation, these material would likewise be required for you to disclose to the other parties:


    • Certificate of title/s for any properties registered solely or jointly under your name and/or the other party. Included are properties that either party has a part in, due to being an officeholder of a corporation or a beneficiary of a trust.
    • Settlement Statements, if any, of the sale or purchase of properties before, during or after the period of living together
    • Any valuations or appraisals for properties that any party to the case has
    • Bank statements for all bank accounts in your name as well as those for any account that you have an interest in or have access to;
    • Any industry valuations (including Redbook) for vehicles in your name;
    • Your employment contract and minimally your last 3 payslips;
    • Tax Returns and Notice of Assessments over the last three years;
    • Superannuation statements for the last 3 years at minimum, as well as the current balance;
    • Documents regarding any business partnership, company or trust in which you may have an interest;


    Failure to Comply to Disclosure Standards and its Consequences


    Failure on the part of either party to provide full and frank disclosure could heavily impact court decisions and as such come with heavy penalties.
    Firstly, the court interpreting such actions as a deliberate attempt to affect the fairness of the court in judging the case, and hence inclines them to make unfavourable judgments on the parties caught doing so.


    Second, it may result in a longer time for case matters to be finalised, leading to protracted period of legal proceedings, which costs both time and money (in the form of legal fees).


    Additionally, it may affect any agreements made between the parties, which could be open to disputation if relevant documents had been kept from disclosure.


    Lastly, the guilty party is liable to punishment. This may take the form of fines, or even imprisonment.


    Given the seriousness of disclosure, it is important that you are prepared with the necessary documents required by Australian legal statutes. Identifying which documents are relevant to a case is not easy to the unacquainted – thankfully, you do not have to do it alone. Consulting with a legal representative about documents for disclosure not only saves time, it could also help in giving you clearer advice for legal proceedings that best help your case in a fair manner.
